Keeping drivers safe with Unavin

In a recent Regulatory Advice from the National Heavy Vehicle Regulatory it state: “If CoR parties install the safety technology but fail to use the telematics data appropriately, because they are unwilling to develop a system to process, monitor, and interpret the data, this is unlikely to meet the threshold of reasonably practicable.” Often the issue for transport operators is not an “unwillingness” to develop their own systems to process and monitor and interpret telematics data but rather a lack of capacity or capability within the business to allow them to access, understand and treat the data effectively.

What is a reasonable excuse?

A recent appeal in the South Australian Supreme Court gives some insight into what may be considered a reasonable excuse under the Heavy Vehicle National Law (HVNL) where the principal obligations generally have very similar wording such as “a person who drives, or permits another person to drive, a heavy vehicle on a road must ensure the vehicle is compliant with requirements applying to the vehicle, unless the person has a reasonable excuse”.

New tipper body design code implementation extended

The National Heavy Vehicle Regulator (NHVR) released Vehicle Standards Bulletin 6 (VSB6), Version 3.2 on 1 July, which saw the implementation of the J4 tipper body design code. Following further review and consultation the NHVR has now extended the transitional arrangements for the implementation of the new design code to 1 February 2024. Owners and modifiers that require an extension to February 2024 need to apply to the NHVR for the extension via email (vehiclestandards@nhvr.gov.au) with their request. This is to allow the NHVR to monitor how industry is progressing as well as target any future communications related to the new code.

Know the height or pay the price

In late June 2023 the NSW Government established a taskforce responsible for reducing the number of overheight heavy vehicle incidents in Sydney’s road tunnel network. Led by Transport for NSW (TfNSW), the taskforce brings together representatives from NSW Police, the NHVR, Road Freight NSW and the Transport Workers’ Union to drive strategies to reduce overheight breaches, educate heavy vehicle drivers on load and route management, and improve operational responses to get traffic moving when incidents do occur.

1.2 million reasons to get your compliance right

In a recent case in Queensland a contracting company has entered a guilty plea to 37 charges of contravening section 26H Category 3 offence of the Heavy Vehicle National Law (HVNL) because it failed to meet the safety duty imposed by section 26C Primary duty of the HVNL. Business has to pay a $1.2 mil fine. It is important to note that neither the drivers nor executive officers of the company were sentenced in the case. Further, the breaches of the drivers are not the basis upon which the company was sentenced.
